Effective March 1, 2020.

Read these terms and conditions carefully (“Terms of use”). These Terms of Use affect your legal rights and obligations, and are a binding legal agreement between you and Mockupdaddy.com.

By accessing or using the Platform and the Service, you agree and accept all these Terms of Use, including the terms set forth in the Privacy Policy that forms a part of these Terms of use and are incorporated herein by reference. If you do not understand the meaning of any of these Terms of Use, do not use the Platform or the Service unless you have contacted us at [email protected]

If you do not agree with any of these Terms of Use, you are not permitted to use the Service or the Products, and you must immediately stop using and accessing the Platform, the Service and the Products contained or available on the Platform.

Definitions

In these Terms of Use, the following terms shall have the following meaning:

Mockup: In manufacturing and design, a model, or model, is a full-scale scale or model of a design or device, used for teaching, demonstration, design evaluation, promotion and other purposes. A model is a prototype if it provides at least part of the functionality of a system and allows the testing of a design.

Client: a natural person with full legal capacity, a natural person who carries out commercial activities, a legal entity or an organisational unit without legal personality, endowed with a legal capacity through special provisions, placing the Order in the Online Store or Use other Services available in the Online Store.

Account: a section of the online store assigned to the customer that can be used to perform specific actions in the online store.

Order: declaration of the Client’s testament that leads directly to the conclusion of a Sale Agreement, specifying in particular the type and quantity of the Goods.

Products: the product presented in the Online Store, with its description available with each of the products presented.

Sale Agreement: an agreement for the sale of Goods within the meaning of the Civil Code, entered into between the Seller and the Client.

Terms of Use for the Online Shop

1. The Online Shop may be accessed if the IT equipment used by the Customer meets the following minimum technical requirements:
a. a computer or a mobile device with access to the Internet,
b. access to electronic mail
c. a browser
d. cookies and javascript turned on in the web browser.

2. Using the Online Shop shall mean every activity of the Customer.

Eligibility

Different countries have different laws and rules, often mutually exclusive. It is not directed to any person or entity in any jurisdiction where, for reasons of nationality, residence, citizenship or otherwise, the publication or availability of the Platform, the Products or the Service, are prohibited, restricted or contrary to laws or local regulations. If this applies to you, you are not authorized to access or use any of the information on this Platform. We do not guarantee that anything on the Platform, including the Products, complies with the requirements and regulations that may exist outside India, or that the Service and Products are available outside of India. If you choose to access this Platform from locations outside of India, you do so at your own risk and assume full responsibility to comply with applicable local laws.

To use the Platform, the Service or the Products, you must have an Internet connection. You are responsible for the costs incurred in accessing the Internet.

Copyright, trademarks and other intellectual property

The products and Materials are protected by the intellectual property laws, trademarks and other intellectual and international property laws of India.

You agree that we or our licensors own, control and retain all rights to the Products and Materials. No right, title or interest in the Products or the Materials is transferred to you as a result of your access, download, printing, viewing or use of the Products and Materials.

Unless we claim ownership of a particular Product, the Products are the property of their respective Authors, not of us. With respect to such designs, we simply provide a Platform for such Products to be available to you as part of the Service.

Our names, logos and tag lines are our trademarks. Your use of the Platform or Products does not grant you a license or otherwise confer any rights to use these trademarks.

User comments, comments and other materials

As part of the Service, we can make available to you the functionality that will allow you to publish, publish, transmit or send your own content, such as reviews, comments or other materials (the “User Generated Content”), or through the Platform or Service. For the purposes of these Terms of Use, the term “User Generated Content” does not include Advances or Products.

Your account

To download Products, you must open an account with us and register as a Member.

You are solely responsible for the use of your account, including the use of your account by other members of your household. By allowing others to access your account, you agree to be responsible for ensuring that they comply with these Terms of Use, and agree to be responsible for your activity as if it were yours. We will not be responsible for any loss arising from the authorized or unauthorised use of your account. If you are aware of an unauthorised use of your account or any breach of security, it is your obligation to notify us immediately. In any case, we will not be responsible for any loss you may incur as a result of unauthorised use of your account.

Purchasing Products

Access to Products is only granted to Members.

With the exception of Products that we may offer to you free of charge, your access to Products requires payment, which you can make using a credit card or payment gateway.

Regardless of which payment method you choose to use, you are responsible for your dealings with your bank.

Payments Using Credit Cards

We reserve the right to charge a handling fee when you purchase Products with a credit card.

Refunds

All sales are final. Because of the nature of Products, unless the Product you purchased is materially different from the Preview, even if you are not fully satisfied with your purchase, you will not receive a refund. Please do your research before you make a purchase. Please consider the suitability of your chosen license and evaluate the Previews. If you need any additional information about a Product that is available for purchase, please contact the Member who uploaded the Product.

Spam & Flood / Data Scraping

You are not allowed to gather information about our Members, including email addresses, from the Platform through harvesting or automated means.

If you post, publish, send, transmit or submit spam, advertising, or other unsolicited communications of any kind to our Members through the Platform or otherwise, you acknowledge that you will have caused substantial harm to us and that the amount of such harm would be extremely difficult to measure. As a reasonable estimation of such harm, you agree to pay us $100 for each such unsolicited communication you send in violation of these Terms of Use.

Disputes with other users

You are solely responsible for your interactions with other Members, including Authors, either online or offline. You agree that we are not responsible for the conduct of any Member or any person accessing the Platform or using the Service.

Links to websites and third-party ads

For your convenience, we may provide links to other websites that may be of interest to you and only for your convenience. Links to third party websites are provided for your convenience and are for informational purposes only. We do not endorse and are not responsible for the accuracy or reliability of any information, data, opinions, advice or statements contained in such linked websites.

License terms for models and assets

For models and assets, we offer two types of licenses you can choose, free and commercial. Check them out at http://mockupdaddy.com/license-mockupdaddy/.

Final Provisions

1. All and any rights of the Online Shop, including economic copyrights, intellectual property rights to its name, internet domain, the Online Shop website, and also to forms, logotypes are the property of the Seller and may be used solely in the manner indicated in and consistent with the Terms and Conditions.

2. Any disputes arising between the Seller and the Customer who is a Consumer shall be settled by competent courts in accordance with applicable provisions of the Code of Civil Procedure.

3. The matters not provided for in these Terms and Conditions shall be governed by the provisions of the Civil Code, the Act on Rendering Electronic Services, the Act on Consumer Rights and other applicable provisions of Polish law.

4. Each Customer shall be informed about any changes to these Terms and Conditions by information available at the homepage of the Online Shop presenting a list of amendments and their effective dates.
